ACCEPTANCE OF TERMS & CONDITIONS
1.1. All orders placed with CASL are subject to the Terms of Business as detailed below.
1.2. Placement of an order implies acceptance of these Terms of Business. We request you read through these terms and conditions carefully before placing any orders. We recommend retaining a printedcopy of these terms for your future reference.
2.1 You confirm that you have Internet access and will provide us with your official email address. CASL will use this method of communication to inform you of any relevant and important information.
2.2 It will be your responsibility to read all emails from us, so as to be fully informed on a regular basis.
2.3 It is your responsibility to read the terms and conditions on each occasion you place your order regardless which method of ordering is used. Your continued ordering shall signify your acceptance to be bound by the latest terms and conditions.
3. ORDER PROCESS
3.1 All orders that you place, howsoever communicated, will be subject to acceptance in accordance with these terms and conditions.
3.2 The customer is required to order in writing to CASL via email or post.
3.3. CASL will not accept any orders via the telephone.
3.4 Before agreeing to accept an order from you, you will be required to complete our clinic New Account form.
3.4 CASL Ltd will only accept orders from authorised personnel within your organisation, of whose names and position within the company we will hold records of. Should these persons change, it is your responsibility to notify us as soon as possible so that we can update our records accordingly. We will not accept any orders from personnel not listed with us.
3.4 As a trade customer, you confirm that you have authority to bind any business, whether incorporated or not, on whose behalf you place orders with CASL. Any order, at the discretion of CASL, may be taken to be a contract between both the ‘business’ and the entity placing the order and CASL, on a joint and several basis.

4. ACCOUNT STATUS
4.1 We regret that we are not able to offer a credit facility for the first 3 orders at this time.
5. PAYMENT TERMS
5.1 All payments are to be made at the time of placing your order.
5.2 Orders will only be processed once payment has cleared.
6. PAYMENT METHODS
6.1 Accepted methods of payment are bank transfer, company cheque, debit or credit cards.
6.2 Credit card fees will incur a charge of 2%, unless by prior arrangement
6.3 The customer is liable for all payment/banking charges.
7. DELIVERY & DISPATCH INFORMATION
7.1 All orders are subject to delivery charges.
7.2 We will always endeavour to find the most cost efficient method, from trusted sources, on behalf of the customer. Shipping charges are calculated by weight or volume (whichever is the greater).
7.3 CASL will aim to dispatch within 2 days or sooner, but in very busy periods this time could be greater and the customer will be advised at time of order of any extended dispatch delays.
7.4 Orders to the UK mainland are normally delivered within 2 to 3 days. Overseas orders are normally delivered within 4 to 5 days.
7.5 Once orders are dispatched from the CASL warehouse, we have little or no influence on their ultimate delivery time. We endeavour to ‘chase’ our transportation suppliers and where appropriate, supply you with relevant tracking details – however we cannot guarantee delivery times as they are not factors within our control.
7.6 All orders require a signature upon delivery. If the transportation company has attempted delivery to the correct and specified address but for whatever reason a redelivery is required, then CASL will not be liable for any charges incurred from this.
8. DAMAGES, QUERIES, MISSING PRODUCTS
8.1 Any goods received damaged or missing from an order must be reported in writing to CASL Head Office address or by email within 48 hours of receipt of the goods. Failure to do so, may at our Danish world class skin care beautepacifique.co.uk. We repair your skin! discretion, result in the goods being deemed satisfactory and no liability for replacement shall arise on CASL.
8.2 Any replacements will only be issued after customer has returned originals together with a returns
number. A returns number is issued by the Head Office within 1 working day from the receipt of the customer’s written notification.
8.3 No replacements or refunds will be given for products returned by the customer that were in turn returned to them by their customer. It is anticipated that in the course of any business, there will always be a small fraction of end customers that may be unhappy with the goods they purchased. It will be the prerogative of the customer to replace, refund or make good their customers’ accounts as they deem fit.
8.4 Where there is a return due to a manufacturing fault, please follow 8.1
9. CANCELLATION OF ORDERS
9.1 In the case of an order being cancelled prior to dispatch, CASL reserve the right to charge 15% of the total order value to cover restocking and administration.
10. PRICES & SPECIFICATION
The following rules apply to all resellers:
10.1 No internet advertising (whether PPC or CPM) outside of the customers website shall display any prices for CASL products.
10.2 Only Websites linked to a professional facility where treatments are offered may advertise CASL on their websites.
10.3 You are not to alter the genuine claims/good-will of the product by specifically inserting additional text or images/removing existing text or images from the existing format.
10.4 No CASL products may be sold on auction websites such as eBay or sold in a shop environment in the Buy-it-Now format (or equivalent)
10.5 All customers must adhere to the recommended retail price provided with purchased goods.
10.6 If any of above mentioned terms and conditions is not adhered to, CASL reserves the right to refuse supply at any time without entering into correspondence.
11. INTELLECTUAL PROPERTY
11.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of the resale or promotion of CASL products Danish world class skin care beautepacifique.co.uk – We repair your skin! shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by our licensors or us.
11. LIABILITY & INDEMNITY
11.1 CASL is not responsible or liable, directly or indirectly, for any form of damages whatsoever resulting from the use or misuse of information contained in or implied in its literature.
11.2 CASL is responsible for the distribution of the products only. No liability is assumed for the use or
misuse of the products.
12. WITHDRAWAL OF FACILITIES
12.1 Should CASL determine that the customer or its servants or agents have brought CASL directors, staff, trademarks, brands or products into disrepute – CASL reserve their right to refuse future supply of goods and services?
13.1 The terms between us shall be governed by the laws of Scotland and any dispute between us will be
resolved exclusively in the courts of Scotland. English is the only language offered for the conclusion of the dispute about the terms and conditions.
13.2 CASL shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
13.3 Branding must comply with the CASL Branding Manual and logos must be in the correct format.
